美国将宁德时代列入中国军事企业清单
US includes CATL in Chinese military companies list

The US Defense Department (DOD) has added Chinese battery giant CATL to a list of companies it says are affiliated with Beijing’s military,Kallanish learns.
中国科技巨头腾讯也被列入1月7日公布的《中国军事企业清单》（CMC清单）。腾讯是微信背后的公司，并一直在为地图服务、大数据和智能电动汽车模型开发基础设施支持。
Chinese tech giant Tencent has also been added to the Chinese Military Companies List (CMC List), which was published on 7 January. Tencent is the company behind WeChat and has been developing infrastructural support for map services, big data, and models for intelligent electric vehicles.
宁德时代表示：“这是一个错误，公司没有参与任何军事相关活动。我们欢迎对我们的业务运营进行负责任的讨论，并认真对待有关我们业务的问题。”
“This is a mistake and the company is not involved in any military-related activities,” CATL states.“We welcome responsible discourse on our business operations and take questions about our business seriously.”
腾讯称：“腾讯被列入这份名单显然是一个错误，我们并不是军工企业或军工供应商。不同于出口管制或其他，这份清单对我们的业务没有影响。尽管如此，我们仍将同美国相关部门共同解决误会。”
“It is obviously a mistake for Tencent to be included in this list,” Tecent claims. “We are not a military enterprise or military supplier. Unlike export controls or other things, this list has no impact on our business. Nevertheless, we will work with relevant US departments to resolve misunderstandings.”
尽管这些公司做出迅速反应，但其股价仍然受到打击。宁德时代在深圳的股价跌幅高达6%，但1月7日收盘时仅下跌3%。腾讯在香港的股价下跌逾7%，其在美国上市的股票在消息发布后也出现类似的波动。
Despite the companies’ prompt response, their stock prices still took a hit. CATL’s shares fell as much as 6% in Shenzhen, though closed at 3% down on 7 January. Tecent’s shares in Hong Kong dropped just over 7%, with a similar movement on its US-listed stock following the news.
一些行业分析师认为，这两家公司今后很可能会提起诉讼。
Some industry analysts believe the two companies will likely file lawsuits in the future.
被列入CMC清单的公司将面临美国与国防相关的采购、合同和投资限制。
Companies listed on the CMC List will face restrictions on defence-related procurement, contracts, and investments by the US.
美国国防部长必须每年定期向国会提交一份已确定的CMC名单。同时，该条款还规定清单的动态更新机制，要求美国国防部长每年至少根据最新信息对清单进行一次审查，并进行增删。
The US Secretary of Defense must submit a list of identified CMCs to Congress on a regular basis each year. At the same time, the provision also stipulates a dynamic update mechanism for the list, requiring the US Secretary of Defense to review the list at least once a year based on the latest information and to add to or delete it.
2024年1月，美国国防部将中国半导体公司中芯国际列入CMC清单，因为该公司在2019年获得中国工业和信息化部颁发的产品冠军。
In January 2024, the DOD included Chinese semiconductor firm SMIC in the CMC list because the company won a product championship issued by the Ministry of Industry and Information Technology of China in 2019.

Last August, SMIC filed a lawsuit in the US District Court of Columbia against the US Department of Defense and the Secretary of Defense. Based on the US Administrative Procedure Act, SMIC accused the department of a decision that lacked factual basis and violated due process.
宁德时代一直在与特斯拉和福特合作，为美国的电池工厂授权其电池制造技术。去年，美国禁止国防部从2027年起采购宁德时代和其他顶级中国制造商生产的电池。此前，出于安全考虑，美国海军陆战队设施安装的宁德时代电池储能系统于2023年底被切断。
CATL has been working with Tesla and Ford to license its battery manufacturing technology for gigafactories in the US. Last year, the US banned the DOD from procuring batteries produced by CATL and other top Chinese manufacturers starting in 2027. This followed the disconnection of a CATL battery storage installed at a US Marine Corps facility in late 2023, under security concerns allegations.
CMC清单包括国有石油和化工公司、船舶和飞机制造公司、电信和半导体制造商。宁德时代是清单中的第一家电池制造商。
The CMC List includes state oil and chemical companies, ship and aircraft buiding firms, telecoms and semiconductor manufacturers. CATL is the first battery maker in the list.
