越南放大招,为搞半导体拟修订建筑、环保、消防许可政策抢夺全球投资资源

10月10日越南企划投资部长阮志勇先生在国会常务委员会会议上说明时提出,就修改和补充规划法、投资法、公私合作法和招标等 4 部法律发表意见。意见内容包括为了缩短项目实施时间,创造有利和有竞争力的机制,并吸引战略投资者。

特殊投资程序适用于采用高科技的工业园区和经济区,包括创新、研发 (R&D) 领域的项目;半导体工业、制造元件和电子电路项目等。

其中起草机构还提出,在工业园区投资的所有领域的项目,不仅仅是高科技和创新项目,都享有“绿色流动机制”。也就是说,投资者注册后,将在15天内考虑获得许可。之后,他们不必办理施工、环境或消防程序,而是立即部署项目。

按照以往的经验,越南投资建厂实施程序和流程中,获得管理机构颁发建筑、环境和消防的许可证的批准程序时间长达 260 天左右。投资者申办这些许可证时必须去一个机构,再去另一个机构,每个机构都有一套文件,有时时间长达数年。

如果修改相关法规后,投资者不必办理这些证件就能立即投资开工建设。意见建议从投资者注册开始 15 天内就能获得投资建设许可。另外投资者只需要一套文件,就可以申请环境、防火和消防等所有领域的许可证,例如规划投资部,并在 30-60 天后回复投资者。

意见希望这次的大力改革能使工业园区的项目,即规划、环境、基础设施都得到明确界定,绿色通道机制和特别程序得到实施。

从检查机构的角度来看,国会经济委员会主席武鸿青先生建议政府能就一些大型、特定、普遍项目拟定特别程序,以免错过投资机会。

国会副主席阮克定先生表示,已经认识到修改与投资和规划相关的四项法律的法律是重大问题,并指出政府将继续进行审查,以“消除真正令人烦恼的问题”。但修改法律后,它必须开辟新的、更好的、更快的事物,而不是更严格地管理,使人民和企业更加困难,同时也不会使不法行为合法化。

预计修订和补充 4 项与投资和规划相关的法律将在 10 月 21 日的开幕会议上提交国民议会审议和讨论。

此前越南范明正总理刚刚签署了 10 月 7 日第 103 号官方电报,内容涉及在 2024 年底及未来几年支持企业消除困难并促进生产经营活动。

在官方电报上,总理要求各部委、部门和地方颁布政策,支持企业在未来几个月和几年内消除困难和障碍,并促进生产和商业活动。各部委、部门和地方在制定和颁布政策的过程中,需要创造有利的环境,帮助企业发展,包括中小企业,使这类企业能够崛起和发展。

同时,鼓励建立大型企业支持机制,推动中小企业打造国内价值链,发展国内配套产业。

强调企业需要实用有效的支持政策,才能在地区之间健康有效地竞争。研究支持降低企业成本以提高竞争力。

据了解,由于越南的财力有限,因此越南更注重在事前对所有的投资活动进行较为严格的监管,因此越南的环保与消防法规设置较为严格,评审阶段不但耗时漫长,各级部门也需要花费大量的人力资源进行相应的资料收集、施工方案审查和风险评估。

而越南在高新科技领域发展相对较慢,在一些越南此次没有类似投资项目的参照情况下,各级部门在审批这些项目时,就需要层层申报申请批示,很多项目长期无法得到快速的回复与响应。

这也导致前几年很多大型半导体、消费电子上游供应链企业,因为废气、废水、废弃物的排放与处理,易燃、易爆化学品的采购、仓储、使用等,在申报环保许可和消防许可时,往往无法快速获得相应的批文。

在时间久拖不决之下,这些企业只能选择临近越南的泰国、印尼、马来西亚或印度建厂,比如上游的锂电池企业、PCB线路板企业等,越南只能承接部分下游的终端产品组装。

此次越南提出修改投资许可法案,也是继疫情放开后,大量供应链企业希望在越南投资产能,但是了前期提交规划后,迟迟无法获得审批,因此有大量的外资投资机构希望越南改善投资环境。

越南此次把事前审批改为事后监管,虽然为企业投资提供了快速通道,但并不意味着企业投资时,在建筑、环保、消防领域的成本会降低。

相反,跟前文所说的一样,越南目前在应急处理这些新行业的建筑、环保、消防领域,即缺乏相应的经验,也缺乏相应的应急处理资源,因此越南各级监管部门,仍会采用较严格的监管机制来处理后续施工与运行的监控。

因此对于项目的设计方与施工方来讲,采取最保守的建筑、环保、消防方案,是避免后期因验收不合格,导致部分项目要重新设计、施工,或整个项目推倒重来的关键。

不过整体来讲,越南政府对高科技行业投资政策的修订,将会极大的方便全球投资者进入越南。而中国供应链企业由于有着长达三十多年的成功经验,在建筑、环保、消防设计、施工领域有着丰富的设计与施工成功案例,对于这些企业投资越南,并引入中国自己的建筑、环保、消防供应商加快建设速度,并推动当地建筑、环保、消防企业的发展,提供了极大的机会。

2024越南国际集成电路及半导体产业展览会

Viet Nam plans to revise its construction, environmental protection and fire protection permit policies to grab global high-tech investment resources

On October 10, Mr. Nguyen Chi Dung, Minister of Strategy and Investment of Viet Nam, presented his views on amending and supplementing four laws, including the Planning Law, the Investment Law, the Public-Private Cooperation Law and the Tendering Law, during a presentation at the meeting of the Standing Committee of the National Assembly. The advice included a view to shortening the implementation time of the project, creating a favourable and competitive mechanism, and attracting strategic investors. The special investment procedure is suitable for industrial parks and economic zones with high technology, including projects in the field of innovation, research and development (R&D); Semiconductor industry, manufacturing components and electronic circuit projects, etc. 

Based on past experience, the approval process for obtaining a building, environmental and fire protection permit issued by the management agency takes about 260 days to implement the procedures and processes for investing in the construction of factories in Viet Nam. Investors applying for these licenses must go to one institution and then another, each with a set of documents, sometimes for several years.

If the relevant regulations are amended, investors can immediately invest in construction without having to apply for these documents. It is recommended that  the investment and construction permit can be obtained within 15 days from the date of registration of the investor. In addition, investors only need one set of documents to apply for permits in all areas such as environmental, fire and fire protection, such as the Ministry of Planning and Investment, and get back to the investor after 30-60 days.

It is hoped that this vigorous reform will lead to a clear definition of the projects in the industrial park, i.e. planning, environment, and infrastructure, and the implementation of the green corridor mechanism and special procedures.

From the point of view of the inspection body, Mr. Wu Hongqing, Chairman of the Economic Committee of the National Assembly, suggested that the government should draw up special procedures for some large-scale, specific and general projects so as not to miss investment opportunities.

Deputy Chairman of the National Assembly, Mr. Nguyen Hak Dinh, said that it was recognized that the law amending the four laws related to investment and planning was a major issue, noting that the government would continue to review it to "eliminate the real bothersome issues". But after the law is amended, it must open up new, better, faster things, rather than being more strictly regulated, making it more difficult for people and businesses, while also not legitimizing wrongdoing.

It is expected that the amendments and additions to the 4 laws related to investment and planning will be submitted to the National Assembly for consideration and discussion at the opening session on October 21.

This comes after Prime Minister Pham Minh Chinh of Viet Nam signed Official Telegram No. 103 dated October 7 on supporting enterprises to overcome difficulties and promote production and business activities at the end of 2024 and in the coming years.

On the official telegram, the prime minister asked ministries, departments and localities to enact policies to support businesses in removing difficulties and obstacles in the coming months and years, as well as to promote production and business activities. Ministries, departments and localities, in the process of formulating and promulgating policies, need to create an enabling environment for enterprises, including small and medium-sized enterprises, to enable them to rise and grow.

At the same time, encourage the establishment of a large enterprise support mechanism, promote small and medium-sized enterprises to build a domestic value chain, and develop domestic supporting industries.

Emphasizing the need for practical and effective support policies for businesses to compete healthily and effectively across regions. Research supports the reduction of business costs to improve competitiveness.

It is understood that due to Viet Nam's limited financial resources, Viet Nam pays more attention to the stricter supervision of all investment activities in advance, so Viet Nam's environmental protection and fire protection regulations are more stringent, and the review stage is not only time-consuming, but also requires a lot of human resources at all levels to spend a lot of human resources for corresponding data collection, construction plan review and risk assessment.

Viet Nam's development in the field of high-tech is relatively slow, and in some cases where Viet Nam does not have a reference for similar investment projects this time, departments at all levels need to apply for approval when approving these projects, and many projects cannot get rapid response and response for a long time.

This has also led to the fact that in the past few years, many large semiconductor and consumer electronics upstream supply chain enterprises have often been unable to obtain corresponding approvals when applying for environmental protection permits and fire protection permits because of the discharge and treatment of waste gas, waste water, and waste, and the procurement, storage, and use of flammable and explosive chemicals. Under the long delay, these companies can only choose Thailand, Indonesia, Malaysia or India near Viet Nam to build factories, such as upstream lithium battery enterprises, PCB circuit board enterprises, etc., Viet Nam can only undertake part of the downstream end product assembly.

Viet Nam's proposal to revise the investment permit law this time is also after the opening of the epidemic, a large number of supply chain enterprises want to invest in Viet Nam's production capacity, but after submitting the plan in the early stage, it has been delayed in obtaining approval, so a large number of foreign investment institutions hope that Viet Nam will improve the investment environment.

Although Viet Nam's change from pre-approval to ex-post supervision provides a fast track for enterprise investment, it does not mean that the cost of enterprise investment in the fields of construction, environmental protection and fire protection will be reduced.

On the contrary, as mentioned above, Viet Nam currently lacks corresponding experience and resources in the fields of construction, environmental protection and fire protection in emergency treatment of these new industries, so Viet Nam's regulatory authorities at all levels will still adopt a stricter supervision mechanism to deal with the monitoring of subsequent construction and operation.

Therefore, for the designer and construction party of the project, adopting the most conservative construction, environmental protection and fire protection plans is the key to avoid the redesign and construction of some projects due to unqualified acceptance in the later stage, or the entire project to be redesigned and constructed, or the entire project to be rebuilt.

However, on the whole, the revision of the Viet Nam government's investment policy on high-tech industries will greatly facilitate global investors to enter Viet Nam. Due to the successful experience of more than 30 years, Chinese supply chain enterprises have rich design and construction success cases in the fields of construction, environmental protection, fire protection design and construction, which provides great opportunities for these enterprises to invest in Viet Nam and introduce China's own construction, environmental protection and fire protection suppliers to accelerate the construction speed and promote the development of local construction, environmental protection and fire protection enterprises.
