Recently, the media has covered the investigation of BYD's factory in Brazil. Given the limited public information available, we refrain from commenting on the specifics of this case. However, this incident serves as a reminder that for Chinese companies expanding overseas, safeguarding workers' rights and interests has become an increasingly critical challenge.

在日常咨询中,我们经常思考如何帮助企业应对这些复杂的问题。从外派人员到选择合适的海外用工模式,再到理解本地化用工与中国实践之间的区别,每一个环节都充满了对不同文化背景下的工作规范、社会价值观及伦理标准的理解需求。这里不仅有规则上的差异,还有背后深深的文化差异。

In our consultations, we frequently explore strategies to assist businesses in navigating these complexities. This includes everything from deploying expatriate staff to selecting appropriate overseas employment models and understanding the nuances between localized employment practices and those prevalent in China. Each step requires a deep understanding of work norms, societal values, and ethical standards across different cultures, which are not only distinct in rules but also fundamentally different in cultural context.

The Influence of Cultural Differences

去年和一位澳洲的朋友聊天时,聊到了孩子教育的问题。她给我讲了一个故事:学校给孩子们布置了一篇作文题目:什么样的人,在你心中是美的。她们家的孩子在作文中提到:我觉得皮肤白的人很漂亮。我们都知道中国有句俗语一白遮百丑,《诗经》中也有肤如凝脂的描述,这些都反映了中国人传统上以白为美的审美观念。

Last year, I had a conversation with a Chinese friend in Australia about children's education. She shared a story where her child wrote an essay on the topic, "What kind of person do you think is beautiful?" The child mentioned, "I think people with fair skin are very pretty." This reflects the traditional Chinese aesthetic that values fairness, as seen in sayings like "a fair complexion covers a multitude of sins" and descriptions in the "Book of Songs" such as "fair skin like cream."

然而,第二天朋友就收到了学校的邮件,通知她需要参加一次谈话,主题是关于作文中提到的以白为美可能涉及肤色歧视的问题。她向学校详细解释了这一观念在中国文化中的背景,最终消除了误会。这个故事的背后确是“文化”之差异,尤其是在处理反歧视和性骚扰等敏感话题时,我们必须给予高度重视。

However, the school contacted my friend for a discussion about potential racial discrimination implied by the child's reference to "fairness". Fortunately, after explaining the cultural context of this concept, the misunderstanding was resolved. Neverthless, this incident highlights the importance of cultural understanding, especially when dealing with sensitive issues like anti-discrimination and sexual harassment.

此外,我们还遇到一位客户在一个国家收到了一张关于未支付加班费的罚款单。当地法律服务市场并不成熟,查明当地法律规定非常困难,不仅因为语言和文化的差异,还因为当地官方信息更新缓慢、不同法系等诸多挑战。

We also encountered a case where a client received a penalty for non-payment of overtime in a country with an underdeveloped legal services market. Navigating local regulations is challenging due to language and cultural barriers, as well as slow updates in official information and the complexity of different legal systems.

中国人一直以勤劳著称,奋斗已经深深植入中国人的基因。然而,许多国家和地区对工时和加班时长有着严格的规定。这不仅仅是工作时间如何计算的问题,更反映了我们对时间价值和工作效率的不同理解。

The Chinese are known for their "hardworking" spirit, with "striving" deeply ingrained in their ethos. However, many countries have strict regulations on working hours and overtime, reflecting different cultural interpretations of time value and work efficiency.

集体协商与工会谈判:新的挑战

Collective Bargaining and Union Negotiations: Emerging Challenges

这几个月来,我们一直密切关注大众汽车与工会的马拉松式谈判。我们不仅关注最终能否达成协议及其实现方式,更重视谈判过程中直播谈判的透明度,以及如果谈判失败可能引发的大规模罢工问题如何妥善解决。

In the past few months, we have also been closely monitoring the protracted negotiations between Volkswagen and the union. Our interest lies not only in the outcome and the agreement's implementation but also in the transparency of the negotiation process and the potential resolution of large-scale strikes should negotiations fail.

幸运的是,圣诞奇迹发生了——德国大众和工会最终达成了劳资协议,避免了工厂关闭的命运,并计划在未来对德国业务进行全面改革。类似集体协商和与工会谈判等问题,将是中国企业走向国际市场后不得不面对的重大挑战。

Fortunately, a "Christmas miracle" occurred—Volkswagen and the union reached a labor agreement, averting factory closures and planning comprehensive reforms for their German operations. Issues like collective bargaining and union negotiations are significant challenges that Chinese companies will face as they enter international markets.
