75-year-old jailed for sexual abuse from 50 years ago

A 75-year-old man was taken into custody at the Kentville, Nova Scotia courthouse after being sentenced to 3½ years in prison for sexually abusing his younger brother during the 1970s. Provincial Court Judge Angela Caseley delivered a stern judgment, emphasizing the profound impact of the long-concealed childhood abuse.

The case stems from incidents that occurred when the victim was a young adolescent, with the abuse taking place in the victim's bedroom during nighttime hours. Judge Caseley highlighted the betrayal of what should have been a safe space, stating, "A child's bedroom should be a safe and secure place. It should be a child's refuge."

The victim first reported the abuse to police in 2022, decades after the incidents occurred. According to the victim impact statement, he carried this traumatic secret for years, only revealing it to his wife when he was 37 years old. The judge read from his statement, which detailed the long-lasting psychological consequences: "There are no words to express the horror and shock of being sexually abused... the lifelong suffering and loss of capacity to enjoy life."

This was not the first time the offender faced sexual abuse charges. Last fall, he received two years of probation for sexually abusing his sister in 1967, when he was considered a young offender at 17 years old.

In her sentencing, Judge Caseley acknowledged mitigating factors, including the offender's guilty plea, his expressed remorse, and his own history of being a sexual abuse victim. The judge noted that the offender had grown up in an abusive household and was struggling with alcohol at the time of the offenses.

However, Caseley emphasized the offender's significant responsibility, stating he chose "his own pleasure over the well-being of a child." The abuse only ceased when the victim finally stood up to his abuser.

The prosecutor's recommended sentence was accepted, with the judge rejecting the defense's request for a conditional sentence and probation.
