Female lawyer raped while 1,000 people watched via livestream

A serious criminal case is being heard at Berlin's Tiergarten District Court involving allegations of sexual assault and unauthorized filming. A 31-year-old lawyer has accused a 46-year-old Bundeswehr officer of assault during a hotel meeting in May 2022 that was allegedly broadcast online without consent.

The accused, identified in German media as Tim B. due to privacy laws, met the victim through a dating app when he was in Berlin for work. According to court documents, what began as a consensual encounter at a hotel in the Mitte district allegedly turned criminal when the defendant violated agreed-upon terms of protection and began filming without permission.

The victim testified that while the initial interaction was consensual, the situation changed when the accused ignored her explicit conditions regarding protection. She states he then began streaming the encounter online without her knowledge or consent, with prosecutors indicating approximately 1,000 viewers had access to the broadcast.

The defendant, a married father of four, disputes these allegations. He claims he maintains an online profile with his wife's knowledge and that all activities were consensual. According to his testimony, he asked about filming beforehand and received approval, though he acknowledges the complainant concealed her face. He further stated the stream reached only 100 viewers at its peak, not 1,000 as alleged by prosecutors.

In his defense, the accused pointed to his actions following the encounter, including providing the complainant with his personally identified train ticket, arguing this behavior was inconsistent with someone who had committed a crime.

However, prosecutors maintain their position, emphasizing the serious nature of the allegations. They specifically noted the potential lasting harm caused by the unauthorized broadcast, stating the recordings "were capable of causing significant damage to her reputation."

The court is scheduled to deliver its verdict on February 10. 

Due to the nature of the case, the victim's identity has been protected, with German media using the pseudonym "Nina" in their reporting.
