9月18日，全国网安标委发布《网络安全标准实践指南——敏感个人信息识别指南》，指南给出了敏感个人信息识别规则以及常见敏感个人信息类别和示例。敏感个人信息是指一旦泄露或者非法使用，容易导致自然人的人格尊严受到侵害或者人身、财产安全受到危害的个人信息，包括生物识别、宗教信仰、特定身份、医疗健康、金融账户、行踪轨迹等信息，以及不满十四周岁未成年人的个人信息。

On September 18, the National Technical Committee 260 on Cybersecurity Standardization Administration of China (TC260) released the Practical Guide to Cybersecurity Standard – Guide for Identifying Sensitive Personal Information. The document provides rules for identifying sensitive personal information, along with common categories and examples of such information. It defines sensitive personal information as personal data whose leakage or illegal use could easily lead to harm to an individual’s dignity or pose risks to their personal or property safety. This includes information such as biometric data, religious beliefs, specific identity information, medical and health records, financial accounts, and location data, as well as personal information of minors under the age of 14.

近日，《网络数据安全管理条例》（国务院令第790号，以下简称“《条例》”）公开发布，自2025年1月1日起施行。

《条例》共9章64条，设定了网络数据安全的底线，划清了网络数据安全的红线。《条例》不仅明确了网络数据安全管理的一般规定，完善了网络数据分类分级保护制度，明确了分类分级保护，细化了网络数据处理活动制度要求，还进一步完善细化了个人信息保护、重要数据安全管理、网络数据跨境安全管理、网络平台服务提供者义务等方面的具体要求，也明确网络数据安全的责任，为提升网络数据安全治理体系提供了更有可操作性的法治保障。

Recently, the State Council, under Order No. 790, issued the Regulations on Network Data Security Management, which are scheduled to take effect on January 1, 2025.

Comprising 64 articles across 9 chapters, the Regulations set the basic requirements for network data security and clearly delineate red-line issues. They establish general provisions on network data security management, mandate classified and graded protection of network data, and provide detailed rules for data processing activities. The Regulations further refine specific requirements for personal information protection, important data security management, cross-border data security management, and the obligations of network platform service providers. The Regulations also define responsibilities for network data security, offering a more actionable legal framework to strengthen the governance system for network data security.

2024年9月2日，国务院办公厅印发《关于以高水平开放推动服务贸易高质量发展的意见》。该文提出推动数据跨境高效便利安全流动，在具备条件的地区开通国际互联网数据专用通道。支持在国家数据跨境传输安全管理制度框架下，建立高效便利安全的数据跨境流动机制，高效开展重要数据和个人信息出境安全评估，优化服务贸易数字化发展环境。

On September 2, 2024, the General Office of the State Council issued the Opinions on Promoting High-Quality Development of Trade in Services through High-Level Opening-up. The document calls for facilitating efficient, convenient, and secure cross-border data flows, by implementing measures such as opening dedicated international internet data channels in qualified regions, supporting the establishment of an efficient, convenient, and secure mechanism for cross-border data flows within the framework of the national cross-border data transmission security management system, efficiently conducting security assessments for outbound transfers of important data and personal information, and optimizing the digital development environment for trade in services.

为落实《中华人民共和国国家互联网信息办公室与澳门特别行政区政府经济财政司关于促进粤港澳大湾区数据跨境流动的合作备忘录》关于“共同制定粤港澳大湾区个人信息跨境标准合同并组织推动实施，加强个人信息跨境标准合同备案管理”的合作措施，国家互联网信息办公室与澳门特别行政区政府经济及科技发展局、澳门特别行政区政府个人资料保护局共同制定《粤港澳大湾区（内地、澳门）个人信息跨境流动标准合同实施指引》，并于2024年9月10日发布。

To implement the cooperative measures outlined in the Memorandum of Cooperation on Promoting Cross-boundary Data Flows within the Guangdong-Hong Kong-Macao Greater Bay Area between the Cyberspace Administration of China (CAC) and the Office of the Secretary for Economy and Finance of the Macao Special Administrative Region, particularly concerning the "joint development and implementation of a standard contract for the cross-boundary transfer of personal information within the Greater Bay Area and strengthening the filing management of such contracts," the CAC, together with the Economic and Technological Development Bureau and the Office for Personal Data Protection of the Macao Special Administrative Region, jointly formulated the Implementation Guidelines on the Standard Contract for Cross-boundary Flow of Personal Information within the Guangdong-Hong Kong-Macao Greater Bay Area (Mainland, Macao), which were released on September 10, 2024.
