According to the Thailand Board of Investment 2023 Report on Foreign Direct Investment (FDI) in Thailand, there were 430 investment projects from China, comprising 30.85% of all foreign investment projects. These projects had a total investment value of 159.39 billion baht, representing 24.03% of the total foreign investment value. Most of these projects were in the machinery and automotive sectors, particularly electric vehicle production. The report predicts further growth in 2024, especially in sectors such as electronics and electric vehicles, supported by Thailand’s favorable investment environment, which includes visa waivers and trade agreements.
As more Chinese enterprises expand into the Thai market, intellectual property protection becomes a key factor in ensuring long-term success. While Thailand’s growing economy offers attractive opportunities for foreign investment, it also presents unique intellectual property related challenges.
1.Intellectual Property Registration and Protection
When entering the Thai market, it is critical to prioritize the registration of patents, trademarks, and designs. Thailand follows a "first to file" system, meaning the first party to register a trademark or patent holds the rights. This ensures legal protection and prevents others from using your innovations, particularly important given Thailand’s issues with counterfeit goods.
If an enterprise encounters bad-faith registration of its intellectual property by another party, Thailand’s intellectual property laws provide mechanisms to address this, such as opposition, invalidation procedures, and intellectual property litigation. Despite the "first to file" system, if a third-party registration is found to be in bad faith, legal actions can be taken to defend legitimate ownership.
2.Intellectual Property Due Diligence
Before expanding into Thailand, Chinese businesses should conduct comprehensive intellectual property due diligence. This includes checking for existing intellectual property rights to avoid conflicts and ensuring that their own trademarks, patents, and designs do not infringe on existing rights. Collaborating with local legal experts can help mitigate risks like unintentional patent infringement, which could lead to costly litigation.
3.Intellectual Property Enforcement Strategy
A strong intellectual property enforcement strategy is crucial for combating counterfeiting and other intellectual property infringements. This includes monitoring the market for counterfeit goods, collaborating with local authorities, and taking swift legal action when necessary. According to the 2023 Annual Report of the Department of Intellectual Property of Thailand, there were 1,463 arrests related to intellectual property violations, with over 2.1 million counterfeit items seized, valued at over 1.2 billion baht.
4. Utilizing BOI and Innovation Incentives
As a Thai governmental agency dedicated to nurturing foreign investment, the Thailand Board of Investment (BOI) offers a wide range of incentives, including tax benefits, land ownership rights, import duty reductions, work permits for skilled foreign employees, etc. It offers various incentives to promote innovation, especially in high-tech sectors such as technology, manufacturing, and biotechnology, which can be particularly advantageous for Chinese enterprises seeking to innovate in Thailand. The BOI’s policies promoting R&D are essential for businesses looking to enhance their intellectual property portfolios.

For Chinese enterprises entering Thailand, an international intellectual property strategy is essential due to the distinct legal frameworks and intellectual property enforcement mechanisms in both countries. Without robust strategies, companies risk facing issues such as counterfeiting, trademark infringements, and loss of competitive advantage. Implementing a strong intellectual property framework not only protects innovations and brands but also establishes a foundation for sustainable growth, allowing enterprises to navigate legal risks while capitalizing on Thailand’s favorable business environment.
