WIPO China: Welcome to the Tenth Session of WIPO Conversation on IP and Frontier Technologies

产权组织对话会第十届会议将于2024年11月5日和6日举行。会议的主题是人工智能的输出:保护还是不保护——这是个知识产权问题

The tenth session of the WIPO Conversation will take place on November 5 and 6, 2024. The topic of the session is AI Output: To protect, or not to protect – that is the IP question.


人工智能正在迅速改变创意和创新产业,在推动经济进步的同时,也引发了有关其对人类创造力有何影响的讨论。随着人工智能工具越来越善于生成内容,关键问题是人工智能是对人类创作者构成威胁,还是在成为有价值的合作者。知识产权领域正在努力应对“输出问题”——人工智能生成的内容是否有资格获得版权保护。版权领域最受关注,政策制定者、法院和许多其他利益攸关方都在努力应对生成式人工智能这一新现象。

AI is rapidly transforming the creative and innovative industries, driving economic progress while sparking debates about its impact on human creativity. As AI tools become increasingly adept at generating content, the key question is whether AI poses a threat to human creators or serves as a valuable collaborator. The IP field, is grappling with the "output problem"—whether AI-generated content should be eligible for Copyright Protection. The field of Copyright has received the most attention with policy makers, courts and many other stakeholders grappling with the new phenomenon that is generative AI.


由于法院和相关机构关注人类参与的必要性,这些讨论的结果将对全球企业产生重大影响。此外,人工智能生成的“深度伪造”的兴起,也引发了围绕语音和肖像权的更广泛的知识产权问题,一些专家甚至主张设立一种新的知识产权!产权组织对话会第十届会议“生成式人工智能:知识产权和输出”将为利益攸关方提供一个探讨这些关键问题的平台。

As courts and relevant authorities focus on the necessity of human involvement, the outcomes of these discussions will have significant implications for businesses worldwide. Furthermore, the rise in AI-generated deepfakes has also resulted in broader IP questions around voice and image rights while some experts have even advocated for a new kind of IP right!  The tenth session of the WIPO Conversation “Generative AI: IP and Output” will offer a platform for stakeholders to explore these critical issues.

知识产权和前沿技术产权组织对话会旨在提供一个开放、包容的论坛,以便在尽可能多的利益攸关方之间,就包括人工智能在内的前沿技术对知识产权的影响展开讨论,积累知识。

The WIPO Conversation on IP and Frontier Technologies provides an open, inclusive forum to engage with and facilitate discussion and knowledge building among the widest possible set of stakeholders on the impact on IP of frontier technologies, including artificial intelligence (AI).


产权组织通常每年举行两届对话会,所采取的形式可以让尽可能多的全球受众参与。对话会的主题包括前沿技术的使用和采用,以协助知识产权局和知识产权权利人,以及更多基于概念的政策讨论。

WIPO generally holds two sessions of the Conversation each year in a format that allows the widest possible global audience to participate. Topics of the Conversation include the uses and applications of frontier technologies to assist IP Offices and IP owners as well as more conceptual policy based discussions.

 

过去五年来,来自172个国家的近9,000人参加了产权组织对话会。

Over the last 5 years, almost 9,000 people have participated in the WIPO Conversation, from 172 countries.


产权组织对话会往届会议重点讨论了人工智能的机器训练、生成式人工智能、元宇宙、数据和知识产权行政管理中的前沿技术。

Past sessions of the WIPO Conversation focused on Machine Training for AI, GenAI, the Metaverse, data and frontier technologies in IP administration.

What are frontier technologies?


前沿技术领域正在迅速发展,尽管对这一概念并没有公认的定义。前沿技术有一些共同的特点。它们在激进的科学进步和现实世界的实施之间运作。此外,它们正在改变我们沟通、解决问题、提供商品和服务、创立并经营企业的方式。前沿技术可以被描述为能够解决全球问题的先进技术。前沿技术包括:1、数字技术,如物联网、区块链、元宇宙、人工智能、大数据和云计算;2、物理技术,如自动驾驶、3D打印和硬件创新;3、生物技术,如基因工程、人体增强和脑机接口。

The field of frontier technologies is rapidly evolving and although there is no agreed definition for this concept, frontier technologies share some common features. They operate at the intersection of radical scientific developments and real-world implementation. Furthermore, they are changing the way we communicate, solve problems, provide goods and services, create and do business. Frontier technologies could be described as advanced technology that can address global issues. Frontier technologies include: digital technologies, such as the Internet of things (loT), blockchain, the metaverse, artificial intelligence (Al), including GenAI, big data and cloud computing; physical technologies, such as autonomous driving, 3D printing and hardware innovations; and biological technologies such as genetic engineering, human augmentation and the brain-computer-interface.

Why does intellectual property matter to frontier technologies?

数据和无形资产是我们数字化新世界的基石。知识产权正在迅速获得比实物资产更重要的地位。我们今天的知识产权制度在制定之初的重点是人类的创造和创新,侧重于鼓励开发有利于实务产品的生产方法及交易的技术。当时设计知识产权制度的背景是,创新创造的速度远远落后于如今的速度。我们当下面临的首要任务之一,是确保当前的知识产权制度在前沿技术时代继续促进创新。

Data and intangible assets are the bedrock of our new, digitalized world. IP is rapidly gaining increasing importance over physical assets. The IP system that we have today was developed with a focus on human creation and innovation and to encourage the development of technologies that enabled production process and trade of physical products. The IP system was also designed when the speed of innovation and creation was much slower than it is today. One of the important tasks that we face today is to ensure that the current IP system continues to promote innovation in the age of frontier technologies.

在新的数字时代,创新和创造的速度更快。知识产权申请的数量正在迅速增加,但也受到更多的波动起伏。市场正在全球化,无形资产的跨境流动更加自由。前沿技术有可能使知识产权和知识产权制度更易于获取、更加有效并且更便于理解。

In the new digital age, innovation and creation are happening much faster. The number of IP filings are increasing rapidly but also subject to more volatile ups and downs. Markets are globalizing and intangible assets are flowing much more freely across borders. Frontier technologies have the potential to make IP and the IP system easier to access, more efficient and more understandable.
