Wife of man killed in fall from lover's car loses legal battle

The wife of a man who died after falling out of his lover’s car in a freak accident has lost her legal bid to claim 600,000 yuan in compensation. The court ruled that the lover was not responsible for the death to the extent required for such a large sum.

The incident occurred in July 2023 in Jiangsu province, eastern China. Wang, a 36-year-old man, had been involved in an extramarital affair with Liu, a woman he met in 2022. On the night of the accident, the couple had a heated argument, after which they went to a bar. The dispute escalated further, and Wang attempted to reconcile with Liu, asking her to return gifts he had given her.

Drunk and without a seatbelt, Wang got into Liu’s BMW after the argument, asking her to give him a ride home. While driving at night, Liu stopped at a restaurant, and the two had a late meal. Afterward, as they left, Wang fell out of the moving vehicle and sustained severe brain injuries. Liu immediately stopped and called an ambulance, but Wang was declared dead 24 hours later in the hospital.

A police investigation revealed that Wang had been trying to end the relationship with Liu, with their final conversation being about breaking up. The authorities did not hold Liu responsible for the accident, although some speculated that the car door was not properly closed, leading to Wang’s fall. Liu had stopped the car immediately, checked Wang’s condition, and sought medical help.

Wang’s wife, children, and parents filed a lawsuit against Liu, seeking compensation for their loss. They demanded 600,000 yuan, claiming that Liu’s negligence contributed to Wang’s death. However, the court ruled in favor of a much lower compensation amount, ordering Liu to pay 65,000 yuan. The court concluded that Liu did not exhibit "serious negligence" or bear "major responsibility" for the accident, although she had failed to exercise "appropriate care."

The court's ruling has sparked online debate, with some commentators pointing out the consequences of Wang’s extramarital affair. One user remarked, "The moral of the story is that you should not have extramarital affairs," while another added, "That’s quite a serious punishment for the husband and his lover."
