简介

从19世纪中叶至20世纪中叶,中国与国际法之间的关系是复杂而多方面的。在国际会议和国际机制中编纂有利于自身的国际法规范,是这段历史时期内中国国际法历史和实践的一个重要方面。从1899年和1907年两次海牙和会的创设,到国际联盟的兴起和衰落,再到联合国的成立,中国的参与和倡议推动了全球法律秩序在诸多方面制定了更明确的规则。这些规则包括领土完整、主权平等和自治、和平解决争端以及限制使用武力等内容。

一方面,尽管遭受着帝国主义压迫和经济剥削,中国外交官和法学家仍然奉行保持接触的战略。保持接触战略往往能产生有意义的影响。另一方面,中国的努力所面临的诸多障碍也表明了这一时期国际法律秩序的不平等和霸权特征,这种特征在冷战初期依然存在。国际法编纂虽然是一个跨国现象,但中国的参与是确保国际法的编纂能取得成果并且保持其前景的一个关键因素。


Chinese encounters with international law from the mid-19th through mid-20th centuries were complex and many-sided. The effort to codify favorable norms in international conferences and institutions was one important dimension of this history. From the innovations of the Hague Conferences to the rise and collapse of the League of Nations, and then its replacement by the United Nations, Chinese proposals helped to push forward more clearly defined rules on a number of aspects of global legal order. These aims reflected national objectives such as territorial integrity, sovereign equality and autonomy, peaceful resolution of disputes, and the limitation of the use of force. 

Despite ongoing experiences of imperialism and economic exploitation, Chinese diplomats and lawyers pursued strategies of engagement that frequently had meaningful impact. On the other hand, the many obstacles facing these efforts also demonstrated the unequal and hegemonic character of the international legal order of this period, which remained the case at the dawn of the Cold War. While codification of international law was very much a transnational phenomenon, Chinese participation in this project was a key factor helping to ensure its achievements and future prospects.


主讲人

简介

穆秋瑞是香港中文大学法学院副教授。他的研究领域包括国际法与比较法、法律史、中国法律和亚洲法律体系等,并且在顶级学术期刊上发表了上述研究领域的成果。同时,他在《外交事务》《纽约时报》《华尔街日报》《金融时报》等媒体上发表了与上述研究领域相关的评论和分析。他的第一本专著Recentering the World: China and the Transformation of International Law由剑桥大学出版社出版。穆秋瑞拥有美国新学院大学的学士学位,哈佛大学法学院的法律博士学位,以及耶鲁大学法学院的法学博士学位,他同时是美国加利福尼亚州律师协会会员。

Ryan Martínez Mitchell is an Associate Professor of Law at the Chinese University of Hong Kong. His scholarly writing on international and comparative law, legal history, Chinese law and Asian legal systems has been published in leading academic journals. His commentary and analysis on these topics has also appeared in Foreign Affairs, The New York Times, The Wall Street Journal, Financial Times, The National Interest, NPR, Bloomberg, Nikkei Asia, Al Jazeera, Foreign Policy, and other major media outlets. His first book, Recentering the World: China and the Transformation of International Law, was published by Cambridge University Press in 2022. Mitchell holds a B.A. from The New School, a J.D. from Harvard Law School, where he was also a Cravath International Fellow and an Irving R. Kaufman Public Interest Fellow, as well as a Ph.D. in Law (with distinction) from Yale Law School, where he was also an Andrew W. Mellon Foundation Humanities Fellow and obtained the Archaia interdisciplinary qualification in the study of premodern societies. He is a member of the State Bar of California and has experience in litigation related to international human rights law within the United States federal court system. He is currently a Non-Resident Fellow at the Quincy Institute for Responsible Statecraft.
