五年来,粤港澳大湾区金融市场互联互通取得了斐然成绩,为区域经济高质量发展打造了样板典范。一系列创新政策相继出台,例如“横琴金融30条”和“前海金融30条”,包含近40项全国或广东首创的金融政策,为互联互通提供制度保障。“跨境理财通”和“互换通”等机制相继落地,有效拓宽了湾区金融市场深度和广度,其中“互换通”是全球首个衍生品市场的互联互通机制。近期,《横琴粤澳深度合作区总体发展规划》和六项金融举措等新措施也相继出台,进一步完善了湾区金融发展政策体系,拓展了个人投资渠道,为企业跨境融资和居民企业支付提供更大便利。
然而,由于“三法域、三税区、三货币”的特殊情况,存在着 A 股及 H 股两个蓬勃发展的资本市场,也存在着活跃流动的境内外资金。希望在此区域获得成功的企业需要学习处理复杂的法律问题,也要能够充分利用既存资源。
本《指南》正是基于这一背景,汇集了跨境电商领域的风险与应对、海商海事领域的最新法律发展、湾区融合背景下内港司法体系互助态势的升级等方面领先法律专家提供对于相关领域有关市场实践的介绍和分析,希望能够助力企业应对上述问题。

It gives us great pleasure to present to you the ALB Legal Guide to the Greater Bay Area 2025. This marks the fifth consecutive year that we have focused on and explored the Guangdong-Hong Kong-Macao Greater Bay Area, a region brimming with opportunities and vitality, through the lens of a legal guide.
Over the past five years, remarkable progress has been made in the interconnection mechanism of the financial market in the Guangdong-Hong Kong-Macao Greater Bay Area, creating a model for high-quality regional economic development. A series of innovative policies have been introduced, including nearly 40 financial policies that are the first in the country or Guangdong, providing institutional guarantees for interconnection mechanism. The implementation of " Cross-boundary Wealth Management Connect" and "Swap Connect" have effectively expanded the depth and breadth of the Greater Bay Area's financial market. Among them, "Swap Connect" is the world's first interconnection mechanism for the derivatives market.
Recently, new measures including the "Overall Development Plan for the Hengqin Guangdong-Macao In-depth Cooperation Zone" and the six financial measures have further improved the Greater Bay Area's financial development policy system, expanded personal investment channels, and provided greater convenience for cross-border financing of enterprises and payment of resident enterprises.
However, given the unique regime of distinct legal systems, currencies and tax policies, there are two booming capital markets of A shares and H shares, as well as vibrant capital flow. Companies eyeing for success need to learn how to cope with complex issues and make the most of existing resources.
This Guide, which complies expert contributions from some of the leading legal commentators on various matters, including risks and strategies in the booming cross-border e-commerce sector, recent legal advancements in maritime law, and the evolving mutual support between mainland and Hong Kong judicial systems under regional integration, hopes to assist companies in resolving some of the challenges.
