A bizarre workplace incident has captured public attention in Beijing, where a former employee's actions and subsequent legal battle made headlines.
Ma, an employee of a Beijing-based automotive company since 2005, was dismissed after smearing feces on a colleague's desk in March 2019. The company cited his actions and subsequent absence from work as grounds for termination.
On March 1, 2019, Ma smeared feces on a coworker's desk, a move deemed a public insult. The Shunyi Branch of the Beijing Public Security Bureau detained him for five days. During this period, Ma did not report to work.
On March 9, the company notified Ma of his termination via text message, citing his absence and violation of company regulations. Dissatisfied, Ma sought arbitration, demanding ¥300,000 in compensation for what he claimed was unlawful dismissal. The arbitration committee rejected his claim, prompting Ma to pursue the case in court.
Both the first and second-instance courts ruled in favor of the company, agreeing that Ma’s dismissal was lawful.
Unyielding, Ma appealed to the Beijing High Court, seeking a retrial. However, the court rejected his application, citing insufficient evidence to prove the company’s termination was unlawful. The court emphasized that Ma was responsible for the consequences of his actions and upheld the previous rulings.
