The police have released three cases to remind foreigners staying in China to complete accommodation registration; otherwise, they may face administrative penalties.
1.
On September 7, 2024, a company located in the Anle Industrial Park of Dongfeng Town received a foreign client. The client temporarily stayed at the company that night, but the company failed to report and register this situation with the public security authorities, which constituted a violation of the regulations on foreigner accommodation registration. Subsequently, the public security authorities imposed an administrative penalty on the company’s person in charge, Mr. Huang.

On September 30, 2024, police officers discovered a Vietnamese woman who had illegally entered the country. She was suspected of renting accommodation in a rental property in Xiaoli Village, Dongfeng Town, and working at a restaurant in the same village. Upon investigation, it was found that the landlord of the rental property, Mr. Hu, had not registered her accommodation information or reported it to the public security authorities. Additionally, the restaurant’s manager, Mr. Liu, had illegally employed a foreign worker. Consequently, the public security authorities imposed administrative penalties on the Vietnamese woman, the landlord Mr. Hu, and the restaurant manager Mr. Liu.

On November 30, 2024, during an inspection of a rental property in Suicheng Village, Dongfeng Town, police officers discovered that one of the tenants was a Vietnamese national. Further investigation revealed that the property’s actual manager, Mr. Liu, had not truthfully registered the foreigner’s accommodation information, thereby violating the regulations on foreigner accommodation registration. The public security authorities subsequently imposed an administrative penalty on Mr. Liu.
According to the Exit and Entry Administration Law of the People's Republic of China and its implementing regulations, foreigners residing in China must comply with certain accommodation registration requirements. These regulations apply not only to hotels but also to other types of residences, such as private homes and schools.
Article 39:
For foreigners staying in hotels in China, the hotels shall, in accordance with the relevant provisions on public security management in the hotel industry, register the foreigners’ accommodation and submit the information to the public security authority in the locality. For foreigners staying in residences other than hotels, the individual or host must register the accommodation with the public security authority in the locality within 24 hours of check-in.
Article 76:
Under any of the following circumstances, a warning may be given, and a fine of up to RMB 2,000 may be imposed:
A foreigner refuses to allow the public security authority to inspect their exit-entry documents.
A foreigner refuses to present their residence documents.
A foreigner fails to register a birth or report a death as required.
A foreigner fails to update changes to their residence registration as required.
A foreigner misuses another person’s exit-entry documents.
A foreigner fails to register their accommodation as required by the second paragraph of Article 39.
When individuals or organizations provide accommodation to foreigners outside of hotels, they should remind the foreigners to register their accommodation at the local police station in a timely manner or take the initiative to register the accommodation on their behalf. Otherwise, once verified, both the host and the foreigner may be subject to administrative penalties in accordance with the law.
