On November 7, 2023, the Convention Abolishing the Requirement of Legalization for Foreign Public Documents (hereinafter referred to as the "Convention") came into effect between China and the United States. Public documents issued in the United States that fall under the scope of the Convention (see Article 1 of the Convention for specifics) only need an Apostille issued by the U.S. authorities to be used in China. There is no need to undergo consular authentication by the Chinese consulates in the United States. Recently, our consulate has received many inquiries about how to obtain an Apostille. To address these concerns, we provide the following instructions:
 1. Inquiries for Documents Issued in the U.S. Intended for Use in China
For documents issued in the U.S. intended for use in China, please consult the U.S. Department of State, state secretary offices, or other relevant departments for information on obtaining an Apostille (for contact information, please refer to [this link](https://www.hcch.net/en/states/authorities/details3/?aid=353)).
 2. Steps to Obtain an Apostille (for Reference):
Step 1: Obtain local notarization for documents such as property authorization, litigation authorization, inheritance waiver declaration, no-spouse declaration, same-person declaration, etc.
Step 2: Take the notarized document to the state government to obtain an Apostille. Please note that the procedures for obtaining an Apostille vary by state, including mail applications, in-person applications, and online pre-approval. Check the relevant state department's website for detailed instructions.
Step 3: After obtaining the Apostille, the document can be directly used in China without any additional procedures at the Chinese consulates.
3. Importance of the Apostille According to the Convention
The Apostille certifies the authenticity of the signature on the public document, the capacity in which the person signing the document acted, and, where appropriate, the identity of the seal or stamp which the document bears. Obtaining an Apostille from the U.S. does not guarantee that the document will be automatically accepted by the document-receiving entity in China. It is advisable to consult the receiving entity in China for specific requirements regarding format, content, validity period, translation, etc., before processing the relevant documents.
