Since 2004
China State Council received complains from foreign nationals from Nigeria, the UK, Pakistan, etc., saying that some hotels have refused their accommodation citing reasons such as "lack of qualifications for handling foreign guests" and "not knowing how to enter information into the registration system," particularly in small cities or budget hotels, causing many inconveniences.
After receiving these complains forwarded by the Chinese government website, the Ministry of Public Security, the Ministry of Commerce, and the National Immigration Administration have seriously studied and responded as follows:
Regarding the inconvenience of accommodation for overseas individuals reported by foreign visitors, the Ministry of Public Security and the National Immigration Administration attach great importance and are actively coordinating with the Ministry of Commerce, the Ministry of Culture and Tourism, and other industry authorities to research and implement measures.
They require that hotels must not refuse to accommodate overseas individuals under the pretext of lacking foreign-related qualifications. They guide and supervise the hotel industry to further improve its capacity to serve foreign guests and enhance the service level of staff.
Currently, the Ministry of Commerce has instructed the China Hotel Association to issue a "Proposal on Facilitating Accommodation Services for Foreigners in China," advocating for strengthening legal and regulatory learning, enhancing reception capabilities, strengthening professional skill training, and other aspects of publicity and guidance to promote accommodation enterprises in improving their foreign-related service levels and providing more convenience for foreigners in China.
They are coordinating with online platforms to offer a series of courses such as hotel English for free, providing training on check-in registration, room reservation, and other hotel English training for accommodation operators on the platform, helping hotel workers improve their foreign language proficiency to better serve foreigners. The Ministry of Public Security is deploying further optimization of hotel accommodation registration management services for overseas individuals nationwide, facilitating accommodation registration for overseas individuals, and creating a better business environment.
Related laws:
Article 39 of the Exit and Entry Administration Law of the People's Republic of China stipulates that "foreigners staying in hotels in China shall have their accommodation registered by the hotel in accordance with the relevant provisions of the hotel industry's public security management and report the registration information of foreigners staying to the local public security organs."
Article 6 of the Measures for Public Security Administration of Hotels stipulates that "hotels must register guests who stay overnight. When registering, they should check the guests' identity documents and register truthfully according to the prescribed items. When receiving overseas guests for accommodation, they should also submit the accommodation registration form to the local public security organs within 24 hours."
Therefore, both Chinese and foreign individuals staying in hotels should handle accommodation registration in accordance with legal provisions, fulfill legal obligations, and public security organs guide hotels to submit accommodation registration information for Chinese and foreign individuals in accordance with regulations.
