电影或电视剧上经常看到，韩国警察在抓人的时候会告知"米兰达原则"。"米兰达原则"来源于美国联邦大法院的"Miranda V. Arizona"判决，大概内容是：有权保持沉默。不保持沉默，所说的一切都能够用于呈堂证供。有权委托律师，委托不了律师，国家会安排律师。并从审讯的开始到结束，行使该权利的机会。目前，美国全境告知的"米兰达原则"的原文如下：
1. You have the rights to remain silent. 2. Anything you say can and will be used against you in a court of law. 3. You have the right to talk to a lawyer and have him present with you while you are being questioned. 4. If you cannot afford to hire a lawyer, one will be appointed to represent you before any questioning, if you wish. 5. You can decide at any time to use these rights and not answer questions or make a statement.
不过在韩国，并不是告知跟美国一样的"米兰达原则"。根据韩国《宪法》第12条第5项及《刑事诉讼法》第200条之五，逮捕时要告知嫌疑事实的要旨、逮捕的理由及委托律师的权利，并给予辩解的机会。如果在逮捕时没有告知该内容，逮捕是违法的。紧急情况下逮捕之后，也要补充说明这些内容。所以不告知"米兰达原则"是并没有问题，但不告知这些内容是违法的。
