美国全国房地产经纪人协会(NAR)和代表房屋卖家的原告已达成一项拟议的和解协议,将结束代表房屋卖家提起的与经纪人佣金相关的索赔诉讼。

NAR  已同意制定一项新规则,禁止在  MLS(Multiple Listing Service)上提供买家经纪人的佣金, 该变更将于2024年7月中旬生效。
对经纪人的影响:
买家经纪人将继续通过多种方式获得佣金补偿,但使用MLS来标明佣金方案将不再是一种选择。买方经纪人可获得的佣金类型将采取多种形式,具体取决于经纪人与消费者的谈判,包括但不限于:
* 固定费用佣金由消费者直接支付
* 卖方的补偿
* 经纪人报酬的一部分
这种变革对购房者和卖家的影响:
* 新规则生效后,经纪人和卖家可以继续提供 买方经纪人服务的补偿,但此类报价无法通过MLS标注
* 代表买家的 MLS 经纪人必须在参观房屋之前与其买家签订书面协议, 帮助客户准确了解哪些服务和将提供价值以及提供多少
诉讼和解协议明确规定,卖方可以提供卖方补偿.  例如买方成交费用通过 MLS标注,前提是此类优惠不以使用买方经纪人或向买方经纪人付款为条件。 
即将到来的地产大变革对买家的影响:
1)房价不含买房经纪人佣金从一个角度来讲相对便宜了
2)购房资金比较紧张的买家付买房经纪人佣金价值的不确定性可能导致他们接受不到高质量的买房经纪人服务
3)买房经纪人佣金从此将不是房价的一部分,首付款比较紧张的买家也无法用贷款来支付买房经纪人佣金

NAR and plaintiffs have reached a proposed settlement agreement that would end litigation of claims brought on behalf of home sellers related to broker commissions. The settlement is subject to court approval.

Implications for members:

There will continue to be many ways in which buyer brokers could be compensated, including through offers of compensation communicated off MLS, but using the MLS to communicate offers of compensation would no longer be an option. 

The types of compensation available for buyer brokers would continue to take multiple forms, depending on broker-consumer negotiations, including but not limited to:

  • Fixed-fee commission paid directly by consumers

  • Concession from the seller

  • Portion of the listing broker’s compensation


Implications for home buyers and sellers:

After the new rule goes into effect, listing brokers and sellers could continue to offer compensation for buyer broker services, but such offers could not be communicated via the MLS. 

MLS participants acting for buyers would be required to enter into written agreements with their buyers before touring a home. These agreements can help consumers understand exactly what services and value will be provided, and for how much.
